Terms of use for Cortisol+. Subscription terms, no-refunds policy, medical disclaimer, acceptable use, limitation of liability, and your responsibilities.

These Terms of Service ("Terms") govern your use of the Cortisol+ mobile app (the "App"), the cortisolplus.com website (the "Website"), and any related services (together, the "Service"), operated by Elevated Systems LLC ("we," "our," "us").

By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service — what it is and what it isn't

Cortisol+ is a consumer wellness app that estimates your cortisol pattern using biometric correlates from Apple Watch (heart rate variability, sleep stages, resting heart rate, recovery balance, wrist temperature). It is intended for general wellness, education, and self-tracking purposes.

Cortisol+ is NOT:

  • A medical device under the regulations of the US Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any equivalent regulator
  • A substitute for professional medical advice, diagnosis, or treatment
  • A diagnostic tool for Cushing's syndrome, Addison's disease, adrenal insufficiency, or any other medical condition
  • A replacement for clinical cortisol testing performed via blood, saliva, or urine
  • Intended to prevent, diagnose, treat, or cure any disease

2. Medical disclaimer

The Service provides educational and wellness information only. Cortisol estimates are research-grade pattern indicators based on validated biometric correlates; they are not absolute values in clinical units (such as mcg/dL or nmol/L).

Always consult a qualified healthcare provider for medical questions or concerns. Do not use the Service to self-diagnose any health condition. Do not start, stop, or change any medication, supplement, treatment, or therapy based solely on output from the Service.

If you experience severe symptoms — including but not limited to rapid weight gain, easy bruising, purple stretch marks, chronic fatigue, persistent sleep disruption, severe anxiety, or any symptoms that worry you — seek medical care immediately.

In a medical emergency, call your local emergency number (911 in the US) or go to the nearest emergency room. Do not rely on the Service for emergency notifications, diagnosis, or response.

3. Eligibility

To use the Service you must be at least 16 years old. By using the Service you represent that:

  • You are at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher)
  • You have the legal capacity to enter into these Terms
  • You are not barred from using the Service under applicable law
  • You will use the Service only for lawful purposes and in accordance with these Terms

4. Account

Some features require you to create an account. If you do:

  • You must provide accurate information and keep it up to date
  • You are responsible for safeguarding your login credentials and for all activity under your account
  • You may not share access to your account
  • You must notify us promptly of any unauthorized access
  • We may suspend or terminate accounts that violate these Terms

5. Subscriptions, billing, and NO REFUNDS

Cortisol+ is free to download and use at a basic level. Advanced features are available through a premium subscription billed through the Apple App Store.

5.1 Billing and auto-renewal

  • Subscriptions are billed through your Apple ID at the price displayed in the App Store at the time of purchase
  • Subscriptions automatically renew at the end of each subscription period (monthly or annual) at the then-current rate, unless you cancel at least 24 hours before the end of the current period
  • Your Apple ID is charged within 24 hours of the end of the current period
  • You can manage and cancel subscriptions through your Apple ID account settings on your iOS device
  • Cancellation takes effect at the end of the current paid period; you keep access until then
  • If a free trial is offered, any unused portion is forfeited when you start a paid subscription

5.2 No refunds

All subscription fees and in-app purchases are non-refundable. We do not provide refunds, partial refunds, or credits for unused subscription periods, accidental purchases, or cancellation mid-period. This applies regardless of the reason for cancellation, including device loss, account deletion, or changes to your circumstances.

Because all transactions are processed through the Apple App Store, Apple may, at its sole discretion, issue refunds in accordance with its own policies. To request a refund directly from Apple, visit reportaproblem.apple.com. Apple's decisions on refunds are final; we do not influence them and cannot reverse a denial.

Statutory rights that cannot be waived under your local law (for example, the 14-day right of withdrawal under EU consumer law) are unaffected by this section.

5.3 Price changes

We may change subscription prices. Existing subscribers will be notified at least 30 days before a price increase takes effect and will have the option to cancel before the new price applies.

6. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to derive source code from the App or Service, except where expressly permitted by applicable law
  • Scrape, crawl, or harvest data from the Website or App through automated means without our written consent
  • Use the social/friends features to harass, threaten, defame, or stalk any other user
  • Misrepresent the Service's output as medical advice, professional opinion, or a diagnostic result
  • Use the Service to develop a competing product
  • Bypass authentication, rate limits, or access controls
  • Upload malicious code, exploit vulnerabilities, or attempt to disrupt the Service
  • Use the Service in violation of any applicable law or regulation
  • Impersonate any person or entity

7. Intellectual property

The Service, including all software, designs, text, graphics, logos, content (excluding your personal data), and the "Cortisol+" name and brand, is the property of Elevated Systems LLC or its licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, redistribute, sell, sublicense, or create derivative works from any part of the Service without our prior written permission.

8. User content

If you use social features (friends, badges, sharing), you retain ownership of content you submit ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to host, display, distribute, and use that content as necessary to operate the Service. You represent that you have all rights to grant this license.

We may remove User Content that violates these Terms or that we reasonably believe to be unlawful, harmful, or inappropriate.

9. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to the Privacy Policy.

10. Third-party services and links

The Service may link to or interoperate with third-party services (including Apple, the App Store, and HealthKit). We are not responsible for the content, accuracy, availability, or practices of third-party services. Your use of third-party services is governed by their own terms and privacy policies.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that cortisol estimates will match clinical measurements. We do not warrant any specific health outcome from use of the Service.

Some jurisdictions do not allow exclusion of certain warranties; in those cases the foregoing exclusions apply to the maximum extent permitted by applicable law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELEVATED SYSTEMS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited or excluded under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Elevated Systems LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Service at any time by deleting the App and, if applicable, your account.

Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by a recognized arbitration body in the United States, except that either party may bring a claim in small-claims court if it qualifies.

You and Elevated Systems LLC waive any right to a jury trial and to participate in a class action. If the class-action waiver is found unenforceable, the entire arbitration agreement will be void.

Consumers resident in the European Union, United Kingdom, or other jurisdictions where mandatory local consumer laws apply retain the right to bring claims in their local courts under their local laws.

16. Changes to these Terms

We may update these Terms. The "Effective date" at the top reflects the latest version. Material changes will be announced in-app and on cortisolplus.com at least 30 days before they take effect when feasible. Continued use of the Service after the effective date constitutes acceptance.

17. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions will continue in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • No agency. These Terms do not create any agency, partnership, joint venture, or employment relationship.

18. Apple App Store specific terms

The following applies because the App is distributed through the Apple App Store:

  • These Terms are between you and Elevated Systems LLC only — not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if applicable (subject to Section 5.2 above).
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
